This bill is largely targeted towards online providers of clear orthodontic aligners such as SmileDirectClub. Under the bill, clear aligners (which are similar to braces) are now classified as a "medical device" and can't be provided to an individual unless they undergo an in-person examination by a dentist, receive dental x-rays, and are provided a prescription for their usage by a dentist. Oppose is the Limited Government Position as this measure represents one of the worst examples of cronyism and utilization of government power to stifle competition under the guise of "consumer protection". This protectionism merely enriches orthodontists and dentists and prevents the free market from expanding competition and lowering costs for consumers. Unfortunately, perhaps due to similar attacks in other states, SmileDirectClub was forced into bankruptcy and shutdown on December 21, 2023.

Expanding Government Power in the Orthodontics Industry to Shutdown Competition by Online Providers of "Clear Aligners" such as SmileDirectClub.

This bill bans the sale or use of so-called "grinch bots" designed to automatically make purchases from websites, often in excess of quantity limitations, disguise the identity of the purchaser, or avoid security measures. These "bots" often make online retail purchases online faster and in larger quantities than a user would be able to, usually intended to allow resale of the items at a profit. Oppose is the Limited Government Position as the private sector - certainly not state government - is best equipped to handle and create counter-measures for issues surrounding "bots". If issues surrounding "bots" do reach a level where there is a role for government involvement (such as to prevent fraud or theft) then the federal government is much better equipped to handle such online threats that may come from individuals in other states or worldwide.

Growing Government Interference in the Private Marketplace through an Overreaching Ban on "Grinch Bots" for Online Sales.

This bill establishes a new regulatory framework for electric vehicle chargers under the Texas Department of Licensing and Regulation. Under the bill, most electric vehicle chargers made available to the public for a fee must be registered with the state and are subject to inspections, fee disclosures, and maintenance standards. Additionally, the Texas Commission of Licensing and Regulation is empowered to establish rules and impose fees to cover administrative costs. Oppose is the Limited Government Position as this bill further grows government power and the regulatory state. This measure will increase costs to electric vehicle owners as the fees charged by the commission will be passed along in the form of higher rates and surcharges.

Growing Government to Now License and Regulate Electric Vehicle Charging Devices.

This bill prohibits state and local governments from imposing COVID-19 vaccine or mask mandates or from ordering private businesses or public or private schools to close for the purpose of stopping the spread of COVID-19. The bill does contain some exceptions for jails, hospitals, and other facilities where other rules conflict. Support is the Limited Government Position as this measure helps protect individual liberties by ensuring it is individuals - not government - making the medical decision on whether or not to receive a vaccination against COVID-19. Additionally, the bill protects against overreaching government mandates related to masks and shutdowns.

Protecting Individual Liberties by Prohibiting Government-Imposed COVID-19 Vaccine or Mask Mandates.

This bill allows cities which have a municipal street sales tax to call an election to authorize the tax for a period of 8 to 10 years if a majority of voters approved the tax in the last 2 elections. In most cities, the duration of the tax is limited to 4 years. Additionally, the bill expands the permitted uses of the tax to include not only maintenance and repair of streets and sidewalks, but now also water, wastewater, or stormwater systems located under a city street. Oppose is the Limited Government Position as this bill reduces government and fiscal accountability by weakening the ability for voters to properly scrutinize the usage of the funding and need for the taxation.

Reducing Government and Fiscal Accountability by Allowing Municipal Tax Levies to Continue for up to 10 Years (Previously 4 Years) without Voter Approval.

This bill provides for the suspension or removal of judges for "persistent or wilful" violations of the laws relating to setting bail. This bill allows property owners who are required to pay municipal ad valorem taxes to file a complaint if the municipality is not providing any required services, such as police, fire, EMS, trash collection, and water service. A municipality must reply within 60 days and if not providing the services, provide a plan of action to do so. If the municipality continues to fail to provide services, a court may order an election allowing the property owners in the effected area to decide whether to disannex from the municipality. This bill comes after the city of Austin has failed to provide services to certain residents on Lake Austin, despite those residents paying municipal taxes. Under this bill individuals with a severe chronic disease are also given the "right to try" an investigational drug, biological product, or device that has completed phase one of a clinical trial but is not yet approved by the FDA, if certain conditions are met. The bill also provides protections for doctors and manufacturers by providing legal immunity from any harm or injury that results from using the investigational product and ensures doctors can recommend such products without facing any disciplinary actions from the state's professional licensing board. Support is the Limited Government Position as this measure strengthens individual liberties and medical freedom by ensuring patients and their doctors - not government bureaucrats - are the ones making decisions over treatment and healthcare.

Strengthening Individual Liberties and Medical Freedom by Providing the "Right to Try" Experimental Drugs to treat Severe Chronic Diseases.

This bill allows localities to implement a property tax credit equal to at least 50% of the value of property used for childcare services. Only facilities in which at least 20% of the children receive subsidized childcare services are eligible. This includes any offense against the student, such as grooming, sexual offenses, and assault. The training materials provided by rideshare companies must meet a long list of requirements and be approved by the Attorney General. Oppose is the Limited Government Position as while human trafficking is certainly a tragedy which society should work to combat, the solution is not the further expansion of the government regulatory state and imposition of new mandates and costs onto the private sector. A much more laudable approach is for the private sector and companies within to invest and establish their own individual procedures to solve societal problems as opposed to the imposition of one-size-fits all government mandates.

This bill permits the Arlington Independent School District to allow the sale and consumption of alcohol at the Center for Visual and Performing Arts facility. Support is the Limited Government Position as this bill expands consumer choice and individual liberties while also generating additional sales tax revenue for taxpayers.

This bill creates a statewide framework for natural gas utility companies to offer energy conservation programs. Hiking Natural Gas Utility Costs for Texans to Enrich Utility Companies and Create New Energy Conservation Programs.

This bill requires the Department of Agriculture to hire an additional government employee to establish the Texas food system security and resiliency planning council. The bill also requires the establishment of a state food system security plan for purposes such as to "provide for the orderly development and management of food system security" and recommend legislation "needed or desirable to facilitate the resilience and availability of food." The federal government already spends billions on stockpiling food and planning for natural disasters. Additionally, the free market and private sector is far more effective in solving all other non-emergency related supply-chain issues as opposed to central planning by government bureaucrats.
